This year’s trip had a sharper edge than most. For the first time in several years, the industry came to DC specifically in opposition to active legislation, not just to make a general case. Two bills are in play: Senator Dick Durbin’s Dietary Supplement Listing Act of 2026 (S.3677), which would require every supplement SKU registered with the FDA before market entry, and the Dietary Supplement Regulatory Uniformity Act (H.R. 7366), introduced by Rep. Nick Langworthy, which needs a Senate companion to stop states from layering their own supplement restrictions on top of federal law.

The group extends thanks to the NPA team, including Dan Fabricant, Jim Emme (of NOW Foods), and the others who show up year after year to fight for the supplement industry.
1:45 – The 2026 NPA Fly-In: Industry on the Offensive
For the first time in several years, the PricePlow crew came to DC to fight back against active legislation rather than advocate broadly. Prior fly-in trips covered adulteration issues, DSHEA education, and aspirational goals like HSA/FSA eligibility for supplements. In 2026, there are real bills with real momentum, and the message from this delegation is clear: they’re here in opposition.
2:15 – Opposing S.3677: The Mandatory Product Listing Problem
Dick Durbin’s Dietary Supplement Listing Act of 2026 (S.3677) is his third attempt at Mandatory Product Listing (MPL), after failed versions in 2022 and 2024. It would require every supplement SKU registered with the FDA before market entry, adding crushing burden on every flavor, size, and variant. Beyond the administrative problems, S.3677 opens a backdoor for Big Pharma: the drug preclusion clause could let them claim emerging natural compounds via investigational new drug (IND) trials that happen entirely out of public view. 5:00 – H.R. 7366: Protecting Supplement Access for Minors
Rep. Nick Langworthy’s Dietary Supplement Regulatory Uniformity Act (H.R. 7366) would make the FDA the sole regulator of supplements and preempt conflicting state requirements. It needs a Senate companion, which is part of why the group was lobbying. At stake: several states have already restricted supplement sales to minors under 18, cutting off creatine and protein for high school athletes chasing college scholarships. A FOIA request to the FDA found zero adverse event reports linking dietary supplements to eating disorders.
7:15 – HSA/FSA Eligibility and the Enforcement Gap

Supplements should qualify for HSA/FSA spending, and the analogy keeps surfacing: some kayak brands have completed the paperwork to become HSA/FSA eligible, so dietary supplements (literally about health) shouldn’t need a workaround. Beyond the spending question, the group’s core message across nearly every meeting that day: the supplement industry isn’t underregulated, it’s underenforced. DSHEA and CFR 111 already provide the framework. The FDA simply needs to use it.
8:00 – Rep. Jim McGovern: An Unexpected Ally
The most memorable meeting was with Rep. Jim McGovern of Massachusetts, who held a genuinely substantive conversation about nutrition access. He wasn’t ready to co-sponsor anything, but offered to connect the group with local contacts and help pursue state-level carve-outs for the pending minor-access bill. It reflects what kept coming up throughout the day: the industry doesn’t need legislative miracles right now. It needs legislators willing to help find them.
11:00 – Teaching the Hill: Explaining How Supplements Are Regulated
Many legislators and staffers don’t understand how dietary supplements are regulated. The group spent time walking offices through DSHEA and CFR 111 basics, including one question that captured the confusion perfectly: “Is vitamin B regulated?” Multiple offices said they’d never gotten such detailed answers from industry groups before. The visit to Elizabeth Warren’s office stood out: her familiarity with pharmaceutical oversight made the contrast with supplement compliance sharp and productive, illustrating exactly why enforcement capacity matters more than more paperwork.
12:45 – Do Your Legislators Take Supplements?
Uday’s go-to opening: ask a staffer if their boss takes supplements. At Chuck Schumer’s office, the question landed with visible surprise, but someone in the group confirmed Schumer takes vitamin D. The logic is direct: legislators who are already supplement consumers have a personal stake in these regulations. The conversation also touched on GLP-1 injectables going mainstream, with a Quicksilver Scientific rep at the event using both a CGM and Mounjaro, having lost 50 pounds in the prior seven months.
14:30 – The Ashwagandha “Gotcha” Moment
One tactic proved consistently effective: ease into conversations with familiar supplement names. At Marsha Blackburn’s office, mentioning ashwagandha prompted an immediate “I love ashwagandha” from the staffer. Moments later, the same person expressed skepticism about supplement access for minors, until the group pointed out that melatonin gummies and elderberry also fall under that definition. Most legislators don’t realize they’re already supplement consumers. Once they do, the conversation changes.
15:45 – DC Is More Accessible Than You Think
The episode wraps with a second consecutive Ted Cruz sighting at the Capitol Grille, which drives home a broader point: DC is more accessible than most people assume. You can schedule meetings, walk in, and make your case directly to a congressman or their staff. Jim Emme’s advice from the closing reception: follow up with every contact every three months. A year of consistent contact turns a stranger into someone who recognizes your face. Future Nutra is already proving it.
